Terms and Conditions

These Terms and Conditions are entered into, on behalf of Over the Rainbow Balloon Flights Ltd

Purchase:

  1. Orders for a Hot Air Balloon Flight Experience are to be made on our standard Booking Form. A receipted copy of your order will be confirmed by first class post.
  2. If you wish to cancel your order, you may do so in writing within seven days of placing your order, after which time, you are bound by all these Terms and Conditions. Vouchers are personalised items and must therefore be returned. There will be an administration charge of £10.00 per voucher.
  3. If you book a flight date within seven days of placing your order you are deemed to have accepted these Terms and Conditions.
  4. This contract is made with you and you may give it to someone else, provided it is stated on the voucher booking form or you notify us, in writing. These Terms and Conditions will then apply to the person to whom you have made the gift.

Our obligations to you:

  1. When you purchase a voucher, we will refer you to our Terms and Conditions, available by email, fax, post or on our website.
  2. Your voucher will entitle you and any other persons specified on your voucher to participate in a hot air balloon flight experience within 12 months of the "valid from" date. This will include preparation and inflation of the balloon for flight, a flight in a hot air balloon, traditional champagne toast, personalised commemorative first flight certificate signed by the pilot, along with the return journey to the launch site, if required.
  3. Your flight experience on any booked date, except in the case of an Exclusive Flight, is subject to matching with a minimum number of other people who wish to fly on the same date and at the same flight time.
  4. If a date for your flight experience is postponed owing to weather, on eight or more occasions during a period of 12 months, we will extend your booking by 12 months.
  5. When you contact us to agree a date, we will confirm the date and meeting time of your flight experience and the date and time of your pre-flight call.
  6. Vouchers are not redeemable for cash.
  7. Hot air balloon flights are completely dependent on the weather and are regulated by the Air Navigation Order. It may be necessary to postpone a flight at any time if in our judgment the conditions are not safe or the flight would not be permitted under the Air Navigation Order. We will give you as much notice as operational procedures allow of any postponement and in order to ensure safety we reserve the right to postpone a flight at any time right up to the moment of launch. In the event of a flight being cancelled by us, owing to adverse weather conditions or for any other reason, the earliest alternative dates will be made available to you when you contact our office.
  8. It is intended that the balloon will be in the air for at least one hour and the Pilot in Command has ultimate responsibility for deciding the duration and conduct of any flight and the appropriate place of any landing. The direction of the flight is controlled by the prevailing winds at the time of the flight and therefore cannot be guaranteed.
  9. Vouchers are non-refundable save for the following exceptions which entitle you to a full refund, less 10% administration costs:
    • If you or a member of your party named on your Booking Form dies OR
    • If you, or a member of your party, named on your Booking Form becomes unfit to fly between the voucher date and the end of the Validity Period.
    In both cases, a general practitioner’s certificate is required by us. If you, or a member of your party as stated on your Booking Form, are unable to fly during the Validity Period of your voucher because you are/she is pregnant, we will extend the validity period by 12 months, provided we have been notified of the pregnancy.
  10. We carry insurance cover against the risk of injury or damage to passengers and their belongings during the course of our flights in accordance with international agreements covering air transport. We can further provide details upon request and if you do not consider this would be adequate to compensate you for any loss whether for death, personal injury or damage to your belongings you should take out your own additional cover.
  11. We do not accept liability for any costs or expenses you incur if we have to postpone any flight.
  12. We reserve the right to change launch sites, if wind direction or airspace restrictions prevent safe flight on the day. In this instance, the flight will be transferred to the nearest alternative site.

Your obligations to us:

  1. You must contact us to agree dates for your flight experience. It is your responsibility to verify and note the date and meeting time of your pre-flight call and flight experience that we have confirmed with you.
  2. You must allow enough time to book at least five dates in the Validity Period in case of weather postponement if you wish us to extend your voucher beyond the end of the Validity Period, free of charge.
  3. You must pay any outstanding balance on your Voucher ten days before the first date for which you have booked your flight, or on-site, for your flight experience.
  4. You must make your pre-flight telephone call to check the weather status and final arrangements for your flight experience in accordance with our instructions.
  5. You must attend at the agreed time to take part in your flight experience to maintain the validity of your Voucher.
  6. You may postpone your flight, up to 48 hours before the meeting time for the flight, which you have booked for, provided that at the time you do so, you re-schedule your flight within a week, for a mutually convenient date.
  7. If you do not give notice of postponement in accordance with clause 6 above, or do not attend in time to take part in your booked flight, you will not be entitled to a re-scheduled flight nor to any refund.
  8. We are not qualified to express an opinion confirming that you are fit to fly and you must ensure that you are fit to fly. You must not fly if you are suffering from any serious medical condition, or have recently undergone surgery unless you have a certificate of your fitness to fly from your doctor. You must not fly if you are pregnant or under the influence of alcohol or drugs.
  9. Our paramount consideration if your safety and the safety of others participating in the flight and you must obey all requests and instructions issued by any of our representatives and take particular care to abide by any safety instructions given. The pilot has complete discretion as to whether to allow you to take part in the flight and will refuse to allow you to do so if in his opinion you would be a risk to the balloon, to other passengers or to yourself.
  10. Ballooning activities intrinsically involve the possibility of physical risks greater than those encountered in daily life even though they are conducted under the supervision of the pilot, who exercises all due precautions to ensure safety. By taking part in such ballooning activities, passengers are understood to be fully aware of these risks.
  11. We will fly children aged eight years to sixteen inclusive when accompanied by an adult. You, and all members of your party must be at least four feet tall.
  12. You should wear such appropriate clothing as is advised to you in advance of the flight and as further detailed in our documentation.
  13. You must not smoke on board our aircraft or within 10 metres.
